WARNING:

INDOOR GROWING OF ANY AMOUNT OF CANNABIS USING ARTIFICIAL LIGHT, HYDROPONICS OR OTHER ARTIFICAL AIDS IS NOW A CRIMINAL OFFENCE!

HEMP SA inc, is ashamed to report that the SA Labor State Government with support from their Liberal mates and prohibitionist pals in the so-called Family First party have passed a bill that will re-criminalise the personal growing of cannabis indoors.

This means anyone growing cannabis indoors (whether using hydroponics or not) will now be subject to criminal penalties and not be eligible to receive an on-the-spot fine.

HEMP has opposed this move since it was first proposed several years ago,
but it looks like we lost the battle.

This will be a counterproductive tragedy, that will concentrate the power of organised crime, increase the level of harm faced by users and the wider community and lead to increased corruption. It will be increasingly expensive, financially and socially and make criminals out of hundreds if not thousands of otherwise law abiding citizens.

HEMP is committed to overturning this and continuing the fight for sensible common sense drug law reform. We need your help if we are to be successful.

GET YOUR FACTS STRAIGHT! SAY LAW REFORMERS

HEMP SA inc, cannabis law reform campaigners calling for the regulation of Cannabis, today slammed the SA State Government for its inaccurate portrayal of the SA Cannabis scene and its blinkered head in the sand approach to hydroponic cannabis as reported in The Advertiser yesterday.

HEMP spokesperson Mr Russell Haynes claimed the government has got its facts wrong, as a cursory examination of the evidence clearly shows. Claims that three plants can be grown within the expiable limit are totally wrong and misleading. The current limit for expiable Cannabis plants is ONE and has been since November 1999! Claims that there are over 100 hydroponic stores in SA are ludicrous - a simple check of the current Yellow Pages shows barely 50 based here. These exaggerations are designed to make the police look helpless in the face of serious syndicated criminals, yet the Police have always had the power to lay criminal charges where this sort of activity is occurring. Mr Haynes said.

The Police have failed to collect the evidence and act on it, preferring instead to pick on Mr & Ms Small rather than go after the Mr Bigs of the trade. Mr Haynes explained The Governments actions fly in the face of the widely supported recommendations of the recently convened Community Drug Summit and will only make matters worse by playing into the hands of the serious hard core element of the drug trade said Mr Haynes.

By exaggerating the situation to make it seem like all indoor growers are major players in the drug trade the Government is in fact condemning all personal growers, the majority of whom grow indoors, to face criminal penalties. This is a fundamental overturning of the C.E.N. system originally designed to remove such personal users/growers from the black market and the criminal justice system and will have major social and economic repercussions for users and society as a whole Mr Haynes warned

RANNS WAR ON CANNABIS USERS

HEMP SA are appalled at SA Premier Mike Ranns war on Cannabis users. Rann has now removed hydroponic (or indoor grown) Cannabis from the CEN (on-the-spot fine) system.

This would mean anyone caught growing ANY amount of Cannabis INDOORS
(whether or not they were using hydroponics) will face court
and the liklihood of a criminal conviction if convicted!

Rann has also said he wants to put out an education campaign about Cannabis due sometime in October, but it is now December and we still haven't seen any sign of it!

HEMP SA understands that the government concern about syndicates exploiting the legislation and making mega-bucks from selling indoor pot here and interstate but they have got it wrong! The CEN legislation was never intended to stop commercial sale and production of Cannabis. There have always been seperate laws for that which maintain severe penalties for those activities. These include fines of up to a MILLION dollars (believe it or not!)

The CEN laws which the government has now effectively scrapped were intended to keep personal users and growers out of the court system and not stigmatise them with criminal convictions for simple personal possession and cultivation offences.

One thing is sure. We shall see more people before the courts, clogging the system and making it more expensive for all South Australian taxpayers who will have to pay for the privilege of convicting their friends, relatives and neighbours. Given the perilous state of our States finances we question what other essential services will be cut to fund these initiatives and just how many people will be sent to jail just for the alleged crime of growing some pot?

LATEST PLANT LIMIT = ONE OUTDOORS!

As of November 2001, the former Liberal government has reduced to ONE (1) the number of plants that is expiable by an on-the-spot fine
(Cannabis Expiation Notice / CEN).

If you get caught with more than one plant you will face criminal charges in court and a possible criminal conviction! Jail terms are also possible!

This applies to outdoor growing only.

Legislation has now been passed, that (once proclaimed and gazetted) will make Indoor Growing (defined as using artifical lighting and/or hydroponics or nutrient solutions) NON-EXPIABLE!

The bill to ban hydroponics and indoor growing was passed in the Lower House before the last election and was re-introduced by Mike Rann
(against the advice of the SA Drug Summit) and was rushed through and passed in the Upper House on December 4th 2002.

Any users of hydroponics or indoor growers now face criminal penalties and a criminal conviction!
